california Senate - Public safety
AB-642 (2023-2024)
Law enforcement agencies: facial recognition technology
District 19 - Assemblymember Ting
Purpose
Sets comprehensive, statewide parameters around law enforcement use of facial recognition technology (FRT). The legislation aims to protect people’s privacy and due process rights, while also helping to keep communities safe with a valuable public safety tool.
It would codify a 98 percent level of accuracy for a match as the bar for use of the technology. It will restrict its use if it prevents someone from exercising constitutional rights such as freedom of assembly. Shorten time for facial recognition, disallow law enforcement to use facial recognition on body cameras.

Position
- Recommended Position: Oppose
- Facial recognition technology (FRT) is much more about exonerating somebody as it is convicting them. It provides more data to prove someone’s innocence, so its uses in law enforcement should not be undermined.
