REPEAL THE DEATH TAX ACT (RDTA)

In 2020, Proposition 19 was presented to voters as a tax benefit and titled as “The Home Protection for Seniors, Severely Disabled, Families, and Victims of Wildfire or Natural Disasters.”
The proposition failed to explain that the measure repealed the constitutional protections in Propositions 58 and 193.
Reassessment of long-held family properties to market value upon the death of a parent means children who can’t or are unable to come up with the cash to pay the new annual property tax bill may be forced to sell the family property.
RDTA restores Proposition 58 and Proposition 193 to the state constitution, restoring the ability of parents to transfer property to their children upon death without triggering a reassessment and increase in property taxes.
The measure adds an adjustment for inflation to the exclusion from reassessment for a limited amount of other property in addition to the primary residence.

- Signature collection ended on April 22.
- May 2022: Did not secure the needed signatures to qualify for the November 2022 ballot.

- Recommended Position: Oppose
- LASCC understood the negative impact Prop 19 would have on our communities. LASCC was the only organization at BizFed to oppose this proposal. LASCC’s position emphasized how it would diminish generational wealth among the most affected in the communities we serve.
